4. Technical or professional ability – the contract may be sought by a contractor who meets the condition regarding technical or professional ability, and in particular demonstrates that: 4.1 not earlier than within the last 3 years, and if the period of conducting business activity is shorter – within this period, they performed at least two contracts (separate contracts) for the lease of at least 100 (one hundred) multifunction devices lasting for a minimum of 12 months;

• in the case of documents confirming the proper performance of deliveries and the list thereof issued in foreign currencies (other than PLN), the values (amounts) specified therein will be converted, for the purposes of evaluating compliance with the condition for participation in the procedure, according to the average PLN exchange rate for that currency announced by the National Bank of Poland as of the date of issuance of the document. 4.2 The contracting authority shall verify and evaluate the conditions for participation in the procedure based on statements and documents and/or certificates issued pursuant to the provisions of the Act of 5 August 2025 on the Certification of Public Procurement Contractors (Journal of Laws of 2025, item 1235, as amended) submitted by the contractors participating in the procedure in accordance with the manner and form referred to in these SWZ [Terms of Reference]. 5.In order to confirm compliance with the conditions for participation, where appropriate and in relation to a specific contract or part thereof, a contractor may rely on the technical or professional abilities or the financial or economic standing of entities providing resources, regardless of the legal nature of the legal relationships between them. 6.With respect to the condition regarding experience, contractors may rely on the capacities of entities providing resources if those entities perform the works or services for the execution of which these capacities are required. 7.Contractors may jointly apply for the award of the contract. 7.1 A contractor relying on the capacities or standing of entities providing resources shall submit, together with the tender, a commitment of the entity providing resources to make the necessary resources available to it for the purposes of performing the given contract, or another subjective means of proof confirming that the contractor, when performing the contract, will have the necessary resources of those entities at its disposal.The above commitment or other means of proof shall be submitted in the form referred to in Chapter IX, Section 1.6 of these SWZ. 8.An entity that has committed to make resources available shall be jointly and severally liable with the contractor relying on its financial or economic standing for damage suffered by the contracting authority resulting from the failure to make those resources available, unless that entity is not at fault for failing to provide the resources. 9.When evaluating technical or professional ability, the contracting authority may, at any stage of the procedure, determine that the contractor does not possess the required abilities if the contractor having conflicting interests, in particular the commitment of the contractor's technical or professional resources to other business ventures of the contractor, may adversely affect the performance of the contract.Pursuant to the provisions of Article 139 of the Public Procurement Law (PPL), the contracting authority will first examine and evaluate the tenders, and then carry out the subjective qualification of the contractor whose tender was ranked highest, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure.The contracting authority shall summon the contractor whose tender was ranked highest to submit, within a specified deadline of not less than ten (10) days from the date of the summons, subjective means of proof (valid as of the date of submission)…
