Economic operators submitting tenders must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional capacity to carry out the activities covered by the contract (the subject matter of the contract must be corresponding in the CAEN codes of the certificate of establishment issued by the ONRC).
The requirement shall also apply to subcontractors who supplement information related to their situation at the level of a separate DUAE. The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation in Part IV: Selection criteria, section A (Capacity to meet requirements).
At the request of the contracting authority shall be presented as supporting documents, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders, the following: (a) Roman legal entities 1) The certificate of establishment issued by the Office of the Trade Register on whose radius the seat of the tenderer is situated. From the certificate / register extract submitted shall result:
- the object of the tenderer's activity. The subject matter of the contract must have a correspondent in CAEN from the finding certificate issued by ONRC;
- the status of the tenderer;
- the persons representing the tenderer in relation to third parties. The information contained in this document must be real / actual at the date of presentation.Note: It is allowed to prove the performance of the professional activity and by presenting the finding certificate issued by ONRC in electronic form, through the InfoCert online service, having incorporated, attached or logically associated the extended electronic signature. b) Foreign legal entities will present documents containing edifying information, translated into Romanian by an authorized translator, real / current information at the time of presentation, proving a form of registration as a natural / legal person or equivalent documents issued in the country of residence and mentioning persons representing the entity in relations with third parties, in accordance with the legal provisions of the country where the bidder is resident.Also, the documents submitted must prove that its activity includes activities such as those subject to public procurement and to contain information on the tender status. The tenderer will present relevant documents to prove the registration form and, in case of certification or professional membership, according to the legal requirements of the country in which the economic operator is established.Note: In the case of a joint offer, each participant in the association shall submit the supporting documents required under Article 196 of Law No 98 / 2016 resulting in the fulfilment of the qualification criteria regarding the ability to exercise the professional activity for the part of the contract it performs.
Request no. 1 - Information on the part / parts of the contract that are performed by subcontractors and their specialization The tenderer has the obligation to specify the part / parts of the contract that he is to subcontract and the proportion of subcontracting, the identification data of the proposed subcontractors, if the latter are known at the time of submission of the offer. In the DUAE completed by the tenderer, the requested information on subcontractors will also be included.
Subcontractors will complete their own DUAE. The subcontracting agreement will be submitted with the DUAE. Specification: Under the legal provisions, the supply activity cannot be subcontracted, it is only possible to subcontract services related to the main supply activity. The supporting documents proving the commitments / agreements will be submitted at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the tender evaluation. Contracts concluded with the subcontractor / subcontractors will be submitted by the successful tenderer when signing the contract.
