Soft SDK OCR/ALPR for automatic reading of license plates

Economic operators participating in the procedure must be legally constituted, must not be in any situation of annulment of the constitution, have the right to carry out the activity related to the subject matter of the contract to be awarded, and their activity must be authorized by the competent authorities, on the basis of Article 15 of the Law no.359 / 2004. Economic operators will present documents to demonstrate the ability to carry out the professional activity:

1. Romanian legal persons Certificate of establishment issued by the National Office of the Trade Register or other equivalent document, from which the subject matter of the economic operator results, the certificate of establishment must contain real / actual information at the time of its submission and must contain information on the status of the tenderer and the persons representing the tenderer in relation to third parties.The subject matter of the contract must have a corresponding in the CAEN code of the finding certificate issued by the ONRC. Where tenders are submitted in association, the finding certificate issued by the ONRC shall be submitted by each member of the association.Note: It is permitted to prove the professional activity capacity and by submitting the finding certificate issued by ONRC in electronic form, via the InfoCert online service, having incorporated, attached or logically associated with the extended electronic signature.
2. Foreign legal / natural persons shall provide proof of registration, attestation and / or authorization with the competent authorities of that country in a form of registration / attestation or professional membership equivalent to the professional category required by the performance of the contract. Note: Non-resident economic operators will present the edifying documents, translated into Romanian by an authorized translator.These documents must be real / current at the time of presentation, prove the form of registration in the country of residence, and include the persons representing the entity in relations with third parties, in accordance with the legal provisions of the country in which the tenderer is resident.The requirement shall also apply to associates / subcontractors who complete information related to their situation at the level of a separate DUAE.Method of implementation: The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are to be submitted, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking drawn up on completion of the evaluation of tenders, after application of the award criterion.Where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the main / secondary activities within the contract with the object of the acquisition will also be required by subcontractors for the part of the contract they will perform.In the case of an offer submitted in association, each associate must submit the necessary documents to demonstrate that it is authorized to carry out its part of the contract. Attention! The information contained in the supporting documents must be valid at the time (date) of their presentation

Information regarding subcontracting (if applicable): In accordance with the provisions of Art. 55 (1) of Law no. 98/2016, as subsequently amended and supplemented, tenderers are required to indicate in the tender:

1. the part/parts of the contract that they intend to subcontract; and
2. the identification details of the proposed subcontractors, if the latter are known at the time of submitting the tender or the request to participate. In accordance with the provisions of Art. 218 (2) of Law no. 98/2016, as subsequently amended and supplemented, subcontractors have the right to opt to be paid directly by the contracting authority. This option shall be exercised upon signing the contract.According to the provisions of Art. 170 of Law 98/2016, no subcontractor must be in a situation leading to exclusion from the award procedure, pursuant to the provisions of Art. 164, Art. 165, Art. 167 of Law 98/2016. Furthermore, subcontractors are obliged to submit the declaration regarding non-compliance with the exclusion grounds under Art. 60 of Law 98/2016.For foreign legal entities, documents shall be submitted in the original language accompanied by a certified translation. Method of fulfillment: The tenderer is required to fill in the ESPD, Part "Selection criteria" - Section C "Technical and professional ability" - subsection "Proportion of subcontracting", explicitly indicating the percentage represented by the subcontracted part/parts for each declared subcontractor.Together with the ESPD and the tender, the Subcontracting Agreement shall also be uploaded to SEAP.According to the provisions of Art. 193 para. (3) of Law no. 98/2016, as subsequently amended and supplemented, if the tenderer/candidate intends to subcontract a part/parts of the contract, the ESPD shall also include information on the part of the contract that is potentially to be subcontracted, and shall have the subcontracting agreement attached.Subcontractors on whose capacities the tenderer/candidate relies must, in turn, complete a separate ESPD, including all the information referred to in Art. 193 para. (1) let. a), as well as that referred to in para. (1) let. b) and
3. of Law no. 98/2016, as subsequently amended and supplemented, which is relevant from the perspective of the capacities of the subcontractors on which the tenderer/candidate relies within the respective award procedure.Thus, the subcontractors shall also specify in the ESPD the information related to the qualification criteria they meet, stating the number and date of the contract/subcontracting agreement for the part proposed for subcontracting.In the case of subcontractors on whose capacities the tenderer/candidate does not rely, the ESPD will only contain the information referred to in para. (1) let. a), respectively, it will present the ESPD solely for the purpose of demonstrating non-fulfillment of any of the exclusion situations mentioned in Art. 164, 165, and 167.The economic operator ranked first after applying the award criterion to the admissible tenders shall prove the fulfillment of the qualification requirements through subcontractors by submitting their supporting documents, at the request of the CA. The contracting authority may reject the proposed subcontractor if it does not meet the qualification requirements regarding capacity or falls within the exclusion grounds, and shall request the candidate/tenderer—only once—to replace it and present another subcontractor.In accordance with Notification 256/2016, subcontracting agreements, as applicable, shall be submitted together with the ESPD.
