What the buyer wants
The subject of the contract is the supply of subscripts and the provision of technical support for the Cisco manufacturer's equipment, all the products required and the duration of the aid is set out in Annex 2. A further specification of the subject-matter of the contract is given in the draft contract, which is annexed to No 1 of the procurement documents.
In view of the fact that the procuring entity has HW funds and SW funds (a licence with support for HW funds) from Cisco, the SW funds are to expire in the future and without them the HW funds cannot be used and the switch to other HW and SW funds would entail disproportionate costs on the part of the procuring entity, the procuring entity considers that in this case the actual subject of the public contract is justified by reference to a particular product or, respectively, the SW resources - licence / subscription and the support of a particular producer whose acquisition is the subject of the contract.
The contracting authority has not accepted the division of the contract into parts, since the subject matter of the contract is one functional unit and is awarded in time.
