An economic operator must be registered in the company register or in the register of self-employed persons; in the case of an economic operator not established in Hungary, it must be registered in a similar register in accordance with Annex XI to Directive 2014 / 24 / EU of the Parliament and of the Council and fulfil any other requirements of that Annex (Art. 65 (1) Kbt. point (c), order Korm. § 26 (1) (a)).

In the case of an economic operator established in Hungary, the contracting authority shall verify the fact of registration from the company register data that may be requested from the company information service or from the register of individual business operators; not established in Hungary shall provide a certificate in accordance with the records listed in Annex XI to Directive 2014 / 24 / EU of the Parliament and of the Council (extract or other certificate or declaration) and indicate the availability of the database where the above requirement can be verified (order Korm. § 26 (1) (a)).

The applicant for reference MSZ1 draws attention to the fact that, in order to demonstrate compliance with the reference eligibility requirement of MSZ1, the supplier must make a statement in the tender by completing the ESPD, in accordance with Article 2 (5) of the Regulation, making a simple declaration in point "alpha 'of Part IV of the form. Pursuant to § 65 (6) Kbt, joint suppliers may meet the required competence requirements.

The requirements which may be applied only individually to economic operators shall, where possible, be met by one of them. In the case of joint tender, each joint tenderer shall submit the EEKD form separately.

Submission of certificates for eligibility requirements is only required if the applicant is requested pursuant to Article 69 (4) to (8) of Kbt. Where a tenderer (joint tenderer) intends to comply with the required competence requirements based on the capacities of another organisation or person, it shall also submit separate EEKD forms completed by the organisations or persons concerned.

In such a case, the organisations or persons making available their capacity shall state only in respect of the eligibility conditions which the tenderer intends to use to demonstrate his suitability. Certificates required by procurement documents containing detailed information on the fulfilment of the MSZ1 eligibility requirement shall be submitted at the request of the contracting authority pursuant to Article 69. § (9) may be used.

MSZ1: Description of the services provided by a tenderer pursuant to Articles 21 (3) (a) and 22 (1) to (2) of the Regulation for a period of 3 years from the date of dispatch of the invitation to tender, declaration / certificate with at least the following content:

• the subject-matter of the service, with a detailed indication of its suitability;
• the amount of performance;
• the date of completion (starting and ending date (year, month, day, details);
• the name of the other party concluding the contract;
• a declaration that the performance has been carried out in accordance with the requirements and the contract. In the event of the existence of the provisions of Article 22 (5) of the Regulation, a statement by a tenderer as to the percentage of the compensation received on the basis of the performance it has carried out. Article 21 / A of the Regulation and Article 22 (2) shall apply.Minimum eligibility requirement MSZ1: A tenderer able to present in his tender a reference to a licence and to the operation and support and implementation of a robotic solution, equivalent to or equivalent to the object of this procurement, in which at least 5 supervised and 2 unsupervised robotic licences were used in the IT environment.For the reference presented, contracting authorities shall take into account the performance completed within three years but not exceeding six years (Article 21 (3a) (a) of the Regulation). The final date for the performance to be presented as a reference shall be within the period of 3 years (36 months) tested.

In accordance with Article 67 of the Kbt. MSZ2. Expert Applicant draws attention to the fact that, in order to demonstrate compliance with the competence requirement of an MSZ2 expert, a tender must be made by filling in the ESPD by making a simple declaration in point "alpha 'of Part IV of the form in accordance with § 2 (5) of the REGULATION. The EEKD is also to be submitted by the entity providing the capacity (§ 67 (3) Kbt and § 3 (3) of the Regulation).
