What the buyer wants
- Order name: System for detecting anomalies in SMTP traffic based on Self-Learning AI.
- The subject of the order* is: 2.1. The execution by the Contractor of the Technical Project, together with the transfer of copyright to the Technical Project and the subsidiary rights; 2.2.Delivery by the Contractor of the Contractor's Localization, at its own expense and risk, of the Device (being the property of the Manufacturer throughout the lifetime of the Agreement) necessary for the proper launch and operation of the System, delivery of the Software (being the ownership of the Manufacturer throughout the lifetime of the Agreement), detailed terms and conditions of the Software License (defined by the Software Manufacturer) together with documents confirming the granting of the Software Licence to the Contractor, as well as providing confirmation that the Manufacturer will provide the Contractor with the Technical Assistant of the Manufacturer, and ensuring that the Contractor uses the Software with the Software and the necessary Software Licences installed on it;2.3.Delivery by the Contractor of the Technical Assistant Manufacturer for the System; 2.4. Implementation by the Contractor of Installation and Implementation Services with integration with the DarkTrace System and preparation of acceptance test reports as well as transfer of copyright to the report and subsidiary rights; 2.5.Implementation by the Contractor of the Performance Documentation together with transfer of copyright to the Post-executive Documentation and subsidiary rights; 2.6. Conduct training workshops by the Contractor for up to 8th System Administrators and transfer copyrights and rights dependent on works in the field of training materials; 2.7. The Service Provider provides 2.8.After the end of the period of service provided by the Contractor, execution by the Contractor, at the expense and risk of the Contractor, dismantling the Device along with the Software installed on it and its removal from the Ordering Location (from the place where the Device is located); 2.9. Granting the Contractor a warranty for the System's installation and implementation services, including the Device and Software supplied.

- The Contractor is obliged to demonstrate that he or she will have at least 2 people who are capable of performing the contract, who will participate in the performance of the contract, and each of these persons shall use the Polish language and in writing, and shall have the appropriate professional qualifications and experience necessary to perform the contract, i.e. 1.1. shall have experience in performing at least 1 (one) project involving the implementation of the offered system (including the Device, the Software installed on it) for the probabilistic risk analysis and advanced e-mail protection in the local environment (on-premises) for the Microsoft Exchange postal system;1.2. shall have experience in performing or performing the Service Services for the System for the Probabilistic Hazard Analysis and Advanced Electronic Email Protection in the local environment (on-premises) for the Microsoft Exchange postal system.
- In order to confirm the fulfilment of the condition of participation, the Contracting Authority requires that a list of persons addressed by the Contractor for the performance of a public contract, in particular those responsible for the provision of services, quality control or management of construction works, together with information on their professional qualifications, powers, experience and education necessary for the performance of a public contract, as well as on the scope of their activities and on the basis of their disposal.
- Article 117(3) of the Act shall apply to Contractors jointly applying for the award of contracts, taking into account Article 117(4) of the Act.
- An economic operator may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between them, to confirm that the conditions for participation in the procedure are met. In that case, the Contractor shall submit the undertaking referred to in Article 118(3) and (4) of the Act together with the offer.
- Pursuant to Article 112(3) of the Act, The Contracting Authority shall not apply the capacity levels specified in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors (Journal of Laws of 2025 item 1235 as amended), since for the subject of the contract referred to in this SWZ, the capacity levels have not been specified.
