Suitability to pursue the profession: The suitability is with the offer by self-declarations gem. Form 124 LD (declaration of eligibility) or the Single European Self-Declaration (EEE). If the tenderer invokes the skills of other companies in order to fulfil the contract, the declarations and certificates in accordance with Form 124 LD must also be submitted on request to those other companies.

Tenderers who do not have their registered office in the Federal Republic of Germany shall present equivalent certificates from recognised bodies in their country of origin. Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine prohibits the award of public contracts or concessions to any person or undertaking having a link with Russia as defined in that provision.

Part of the procurement document is a self-declaration of Regulation EU 2022-576, which must be submitted with the tender. The client will request an extract from the Central Commercial Register (§150a Business Code) from the Federal Central Register for the bidder who is to receive the contract. Foreign tenderers shall provide equivalent certificates from their country of origin. The tenderer shall take into account compliance with the minimum charge schemes.
