What the buyer wants
Companies are entitled to compliance with the bidder and applicant protection provisions regarding the procurement procedure vis-à-vis the contracting entity. If a company interested in the tendered contract is infringed on its rights by non-compliance with procurement rules, it must notify the customer of this breach within a period of 10 calendar days (§ 160 para 3 p. 1 no. 1 GWB).

If the client informs the company that he does not wish to remedy his complaint, the company has the opportunity to submit a request for review to the awarding chamber within 15 days of receipt of this communication (§ 160 para 3 p. 1 no. 4 GWB). Responsibility lies with the Procurement Chamber designated under point VI.4.1. Bidders whose tenders are not to be considered for the contract will be awarded before the award in accordance with § 134 Abs. 1 GWB about the intended disregard and the intention to win.
A contract may not be concluded until 15 calendar days after the sending of this information by the contracting entity; where the information is transmitted by fax or electronic means, that period shall be 10 calendar days. It shall begin on the day following the sending of the information by the Client. Note: In the case of a request for review, the contracting authority/entity is obliged to forward to the awarding chamber the procurement documents which also contain the tenders submitted.
Participants have a right of access to files pursuant to § 165 GWB. In order to protect trade and business secrets, you inform us specifically with reference to the corresponding documents of the offer, which information is to be treated as trade and business secrets.

The company’s turnover in the last three financial years in so far as it relates to services comparable to the service to be awarded, including the share of services performed together with other undertakings. Proof: self-declaration Minimum turnover: 50.000,00 EUR

Professional/company liability insurance of more than EUR 0.5 million for personal injury and for property damage. Proof of valid professional liability insurance (not older than 6 months at the submission date) with an EU licensed civil liability insurer. If the existing amount of cover is not sufficient: submission of a declaration of commitment by the applicant that, in the case of a contract, the amount of cover is increased to the specified amounts at his own expense. In the case of groupings of bidders, the full amount of the insurance cover shall cover all members. The proof of liability insurance shall be kept separately for each member for each group of bidders.
