Delivery of licenses and support from the software manufacturer for the system for monitoring changes on network devices, based on products from TUFIN or equivalent solutions, along with the provision of maintenance services

The Contracting Authority shall inform the Contracting Authority that, when determining the conditions for participation in a technical or professional capacity procedure, it shall not apply the capacity levels laid down in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors, hereinafter referred to as ‘uCer’, or ‘the Act on certification of public procurement contractors’, as the capacity levels have not been defined for the subject matter of this contract.

Therefore, the Contracting Authority shall lay down the following conditions for participation in the proceedings concerning technical or professional capacity: The Contracting Authority shall consider the condition to be fulfilled if the Contractor demonstrates that during the last 3 (three) years before the deadline for the submission of tenders and if the period of business is shorter - during that period, he has duly executed: - at least 2 (two) contracts consisting of: the supply and implementation and provision of maintenance or technical support services for a period of at least 12 months of systems for the central management of network security policies, the automation of processes for the modification of the configuration of security devices or the management of the configuration of network and security equipment, with a value of at least PLN 300 00/100 gross (in words: PLN 300 thousand 00/100) each.

The Contracting Authority shall inform that, where periodic or continuous benefits are the subject of the contract, not only contracts executed (i.e. completed), but also contracts performed. In this case, the Contracting Authority shall require that the value of the part of the order completed until the deadline for the submission of tenders is not less than PLN 300 000,00 gross (in words: PLN three hundred thousand 00/100) each.

Where the value of the contract is expressed in a currency other than PLN, The contractor shall be obliged to convert it to PLN on the basis of the average exchange rate of the currency published by the NBP (as shown in Table A of the Exchange Rates of Foreign Exchange) on the day of publication of this contract in the Official Journal of the European Union.

If the publication of a contract notice in the Official Journal of the European Union occurs on the day when the NBP does not publish the average rate table, the rate from the average rate table, published on the next day following the publication of the contract notice in the Official Journal of the European Union, shall be adopted.

The Contracting Authority shall consider the condition to be satisfied if the Contractor demonstrates that he has, or will have, at least one (1) person intended to carry out the contract having over the last 3 (three) years before the deadline for the submission of tenders, experience in the implementation and provision of maintenance services or technical support of systems for the management of network security policies and the automation of changes in the configuration of security devices or the management of the configuration of network and security devices, acquired in at least one project carried out for a minimum period of 12 months, with the current certification of the Tufin software partner or an equivalent solution offered. In the case of the submission of equivalent certificates, they are required to include:

• having the same scope and level of knowledge and experience;
• confirming the certificate with an examination if obtaining a certificate requires an examination. An equivalent certificate may not be issued by the Contractor or a subsidiary of the Contractor.
