EVB-IT Framework Agreement: Grade and Certificate Management Software

The bidder shall specify the supply chain management and supply chain monitoring system available to it for performance of the contract.

At least three appropriate reference orders from the company in the last three years. Orders with a term of 12 or more months are expected. A reference contract shall be suitable provided that it is comparable in nature and scope to the subject-matter of the contract. A reference order is comparable if it includes:

• the provision and implementation of web-based software for the management of performance evaluations and the creation of certificates or a functionally comparable specialist application in the school or education sector,
• the introduction of the application to a plurality of facilities or organizational units including piloting and rollout,
• the integration of the application into an existing IT system landscape via interfaces, in particular for user and rights management as well as for the automated exchange of master and specialist data,
• the operation of the application as a SaaS solution including maintenance and 3rd-level support or as the provision of an on-premise solution (hosting at the client) and maintenance/support,
• the processing of personal data in the order of at least 10,000 users (students and teachers) or more than 20 schools or a technically and organizationally comparable scale, including the handling of time-focused load peaks. Current contracts for which the comparable services have been provided within the last three years or less shall also be valued.

Self-declaration that the employees intended for the provision of services are fluent in the German language in word and writing.- Annex 4 point 3.3 (according to form)

Total number of the company’s average annual number of employees and the number of its managers in the last three years. - Annex 4, point 3.1 (by form)

Total number of permanent employees and managers in the field of activity of the contract in the last three completed financial years. - Annex 4, point 3.2.1 (by form) Total number of technical specialists employed on average by the undertaking in the field of activity of the contract in the last three years. - Annex 4, point 3.2.2 (by form)

The tender shall indicate to what extent and for which parts of the contract the use of third parties is envisaged or the capacity of third parties. It must be ensured that this can be agreed with the contractual execution of the service. Further details can be found in the application conditions (points 2.9 and 2.10). Insofar as the bidder wants to use resources from third parties/subcontractors to prove the performance (suitability loan), point 2.11 of the application conditions must be observed.

Current (not older than six months since the date of dispatch of the contract notice) Proof of the existence of a company liability insurance or a comparable insurance from a member state of the EU with a minimum amount of cover of 3.0 million. Or the bidder confirms that for his company a company liability insurance or a comparable insurance from a member state of the EU with a coverage of at least 3.0 million euros for property, persons and property damage in the case of award of the contract is concluded. After the award of the contract, proof of the existence of the said insurance shall be provided without request and without delay. - Annex 3, point 4 (form)

- The bidder shall provide a current (i.e. not older than three months from the date of dispatch of the contract notice) copy of a bank statement from the bidder’s bank showing its current financial and liquidity position. - The bidder submits a company presentation (in particular business fields, the company and organizational structure, the locations and branches of the company, the service portfolio in relation to the object of the contract, as well as the percentage distribution of the clients by private sector and public client). The bidder shall provide a copy of the last published annual financial statements (to the extent that their publication is required by law in the country where the bidder is established) or in the case of non-publication companies, a copy of the last balance sheet or business analysis. The client reserves the right to request a current (i.e. not older than 3 months since the date of dispatch of the contract notice) business evaluation (BWA).

The tenderer shall provide a copy of a current commercial register extract not older than six months from the date of dispatch of the contract notice. This serves in particular to prove the registration of the legal representative or, in the case of a legal authorisation, to prove the legally binding signing of the deed of authority.
