What the buyer wants

  1. The subject of the contract is the delivery of temporary licences (subscriptions) for a period of 12 months per System, the provision of technical support to the System manufacturer and technical assistance to the Contractor.
  2. The Contracting Authority informs that it has implemented the Database Activity Monitoring System - DAM based on the implementation of the IMPERVA DAM system. Subscription to the system ends on 17 December 2026.
  3. Number of system subscriptions – 8 pcs.
  4. The contractor will provide limited time licenses (subscriptions) of the IMPERVA DAM system, valid. for 12 months from 18 December 2026 or provide and implement an equivalent solution.
  5. As part of the performance of the object of the contract, the Contractor will be obliged in particular to:
  1. Providing limited-time licenses (subscriptions), the IMPERVA DAM system, valid for 12 months starting on 18 December 2026, due to the need to maintain continuity of access to the System or provide and implement an equivalent solution;
  2. Providing Technical Support to the Manufacturer;
  3. Benefits of Technical Assistant Contractor of 2 (two) hours a month. Unused consultation hours shall pass for the following months.
  4. Functional equivalence of the offered solution: The contractor will provide time licenses (subscriptions) for 12 months for the database activity monitoring system (DAM system). The system will be licensed per database server, understood as the instance of the operating system on which the database engine was installed.The Ordering Party may install any number of implementing modules and central management component within the purchased number of database servers. In order to increase efficiency and reliability, the Ordering Party may combine implementing modules into clusters. DAM must monitor on-site databases installed in the AWS, AZURE, GPC cloud.The specific requirements for an equivalent solution are set out in Annex No 1 to the EGM — Description of the subject matter of the contract.
  5. The detailed description of the subject matter of the contract, the terms of the guarantee and the manner in which the contract is carried out are set out in Annex 1 to the WWZ – Description of the subject-matter of the contract, in Annex 3 to the WWZ – Important provisions of the contract and in Annex 3a to the WWZ – model contract for entrusting the processing of personal data.Maximum delivery time: up to 13 months, including: 1) Contractor will provide limited time-limited licenses (subscriptions) The IMPERVA DAM system or will provide and implement an equivalent solution, within a maximum period of 15 working days from the date of signature of the contract.Term of delivery of temporary limited licences (subscriptions) The IMPERVA DAM system or the supply and implementation of an equivalent solution shall be one of the criteria for assessing offers in this proceeding. 2. Licences or equivalent arrangements provided and implemented shall be valid for a period of 12 months not earlier than 18 December 2026, given the need to maintain continuity of access to the Site. 3.The Contractor shall provide a technical support service to the manufacturer of the offered system for a period of 12 months after the date of execution of the activities referred to in point 1 (not earlier than 18 December 2026).
    • Technical assistance of the Contractor for the operation of the DAM system at least 2 hours per month. The Contracting Authority shall specify the time limit for the performance of the contract by a specific date, since, in accordance with Article 436(1) Pzp, this is justified by the objective reason, i.e. by the need to maintain the continuity of the operation of the System.

The contractor shall comply with this condition if it demonstrates that: he has duly performed in the case of recurring or continuous benefits also* during the last 3 (three) years before the deadline for the submission of tenders, and if the period of business is shorter - during that period, at least 1 (one) order, with a value of not less than PLN 100 000.00 (in words: one hundred thousand PLN 00/100) gross, the subject of which was servicing the DAM/DFB security system for a minimum period of 6 (six) months. *if the Contractor invokes the proper provision of a periodic service or continuous servicing of the DAM/DFB database security system The Ordering Party allows not only orders executed (i.e. completed), but also executed.

In this case, the Contracting Authority requires that the period of service (for DAM/DFB service) is not less than 6 (six) months until the time limit for the submission of tenders in this procedure. One service shall mean a service provided under one contract.

The contractor shall comply with this condition if he demonstrates that he/she has, or will have, persons, who are responsible for the performance of the public contract, who have the professional qualifications, qualifications, experience and education necessary for the performance of the contract, i.e. at least 2 persons – Engineer I and Engineer II – who will provide technical assistance to the DAM/DFB database security system and consulting services in the public procurement team, and at the same time each of them:

  • has a certificate of the manufacturer of the DAM/DFB system offered, confirming the competence and technical knowledge in administering the DAM/DFB systems;
  • has experience in implementing and servicing the DAM system offered, at least one (1) fully completed project, with a value of at least PLN 100,000 gross;
  • uses Polish to the running degree. The Contracting Authority requires that another person is designated for each function (i.e. Engineer I and Engineer II). In the case of Contractors jointly applying for a contract, the conditions described above may be met by one or all of them Contractors jointly applying for a public contract.

  1. Wykonawca zobowiązany jest do zabezpieczenia swojej oferty wadium w wysokości: 6 000,00 złotych (słownie: sześć tysięcy złotych 00/100).
  2. Wadium wnosi się przed upływem terminu składania ofert i utrzymuje nieprzerwanie do dnia upływu terminu związania ofertą, z wyjątkiem przypadków, o których mowa w art. 98 ust. 1 pkt 2 i 3 oraz ust. 2 Pzp.

  6. Wadium wnoszone w formie poręczeń lub gwarancji musi spełniać co najmniej poniższe wymagania:
  1. musi obejmować odpowiedzialność za wszystkie przypadki powodujące utratę wadium przez Wykonawcę określone w Pzp, bez potwierdzania tych okoliczności;
  2. z jej treści powinno jednoznacznej wynikać zobowiązanie gwaranta do zapłaty całej kwoty wadium;
  3. powinno być nieodwołalne i bezwarunkowe oraz płatne na pierwsze żądanie;
