What the buyer wants

1. Purpose of procurement: The client intends to procure consulting and support services for the establishment, operationalization and further development of Hamburg-wide data governance. The subject of the services is the technical, methodological and project-related support of the client in the further development of structures, processes, standards, methods and instruments for a strategic, responsible, legally secure and usage-oriented handling of data within the Hamburg administration.

The services are intended in particular to make data stocks more transparent, to improve their quality and usability, to promote the exchange of data and the reuse of appropriate data, and to provide a uniform basis for data management, data classification, metadata management and data-related decision-making processes. The consultation takes place in a dynamic transformation environment.

The contractor therefore supports the client not only in the conceptual elaboration, but - as far as requested - also in the practical testing, introduction, communication and further development of the elaborated approaches in selected areas of the Hamburg administration. Initial situation and strategic context: Hamburg-wide data governance forms the organizational and methodological foundation for data-related administration projects.

It creates the conditions for data to be able to be found, understood, reliable, adequately protected and, as far as technically and legally permissible, usable across organisational boundaries. Data governance is closely related to the client’s data strategy and data management. In particular, its task is to transform strategic objectives and guidelines into applicable regulations, role models, processes, standards and work aids and to support their practical application within the administration. The relevant fields of action include in particular:

  • data ethics,
  • data culture,
  • roles and data competence,
  • data documentation,
  • data networking and data integration,
  • data architecture and data modeling,
  • legal framework,
  • data quality,
  • data use and
  • data sovereignty. An essential tool for supporting data governance is the so-called data map. As an administrative metadata platform, this should create transparency about which institutions collect and maintain which data, which key figures and reports are based on this data and which systems and procedures are used.In particular, the data map is intended to support data inventories, the production of a uniform and comprehensible data basis for key figures, legal impact assessments and the identification of potential for administrative data use and in the sense of the once-only principle.Objective of commissioning: The aim of commissioning is to support the client through needs-oriented consulting and support services in the gradual establishment, operationalization and further development of Hamburg-wide data governance.

For this purpose, the contractor should in particular support the client in developing a consistent target image for Hamburg-wide data governance; - to translate strategic guiding principles into concrete regulations, roles, processes, standards, methods and work aids; - make data stocks, data flows, responsibilities and usage contexts more transparent; - systematically develop data quality, data classification and data documentation;

- further develop data governance tools, in particular the data map, methodologically and conceptually; - to test developed approaches in selected specialist authorities or other pilot areas and to accompany their implementation methodically; involve relevant stakeholders within the administration and support interdisciplinary coordination processes; - to develop robust and controllable decision-making bases for the responsible management levels;

to promote the acceptance and sustainable anchoring of a responsible and data-oriented way of working within the administration. The consulting and support services are aime…

  • The company-related reference project must have included the provision of consulting and support services in the area of the establishment and / or further development of data governance.The services provided under the enterprise reference project shall have comprised at least five (5) of the following sub-areas (sub-areas 1 to 11): (o) sub-area 1: development or further development of a target image, strategic guiding principles or data governance strategy; Part 2: Development or further development of roles, responsibilities and decision-making structures in the context of data governance;(o) sub-area 3: development or further development of data management policies, processes, standards, methods or work tools; sub-area 4: data classification, data documentation or metadata management; (o) sub-area 5: development or further development of approaches and measures to ensure and improve data quality; (o) sub-area 6: creating transparency on data stocks, data flows, responsibilities or usage contexts;sub-area 7: support for data networking, data integration or data use; Part 8: Consideration and implementation of legal requirements related to data governance; Part 9: Testing, implementation or further development of data governance structures in organisations or individual areas of the organisation;Part 10: Involvement of relevant stakeholders and design and moderation of workshops or comparable participation and coordination formats; o Part 11: Development of decision-making bases or recommendations for action for management or control levels.A sub-area shall only be considered as one of the five sub-areas specified (5) to meet the minimum requirement if the reference recipient has provided the advisory and support services underlying the sub-area in question to an extent of at least one (1) person day. Services with a lower time scale are not taken into account when meeting the minimum requirement.The applicant shall indicate in Appendix 206 "Enterprise-related reference projects" which of the aforementioned sub-areas were provided within the specified enterprise-related reference project. The five (5) specified sub-areas must have been provided in full by the reference subscriber himself. The provision of services by other members of a consortium, subcontractors or other third parties does not meet this minimum requirement.
  • Delivery period
  • The specified sub-areas must have been provided and completed completely within the period between 01.01.2022 and the expiry of the participation period in the present procurement procedure. For each of the specified sub-areas, the start date (commencement of activity) and end date (termination of activity) shall be provided in the format dd.mm.yyyy; the dates shall in principle be given in the format dd.mm.yyyy.If compliance with the respective minimum requirement can also be clearly established on the basis of the indication of month and year, the indication of month and year (MM.YYYY) is also sufficient for both the start and the end of the respective performance phase.

Parts whose service provision is not yet completed by the end of the period for participation shall not be taken into account in the examination of the minimum requirement. The company-related reference project may have already started before 01.01.2022 and may continue at the end of the participation period in the present procurement procedure. Relevantly, the sub-areas specified to meet the minimum requirement have each been fully completed within the specifi…

Start of the continuation (Part 1) ***: In order to ensure sufficient competition, it is pointed out that relevant services that date back more than three (3) years are also taken into account (see § 46 para 3 no. 1 Hs. 2 VgV); because the period from 01.01.2022 until the end of the participation period is more than 36 months and 0 days. This is to ensure sufficient competition, in particular because it gives candidates and the contracting entity the same understanding of the relevant period of service.

If an applicant/candidate community cannot specify at least one (1) suitable company-related reference project that meets the established (minimum) requirements (cumulatively), this leads to the exclusion of the application for participation. In this respect, it would not be possible to demand it.

In the case of consortia of candidates/tenderers, at least one (1) appropriate business-related reference project shall be indicated in total; in addition, it must be clear which services have been provided in which reference project which member of the applicant / bidding community. Only those company-related reference projects of the members of the applicant/tendering community that meet the minimum requirements are attributed to the applicant/tendering community.

Proper information: A transmission of negligent or intentionally misleading information can be proven § 124 Abs. 1 no. 9 lit. c of the Act against Restrictions of Competition (GWB) lead to the exclusion of procurement procedures by contracting authorities. Note: The above requirements are minimum requirements for the company-related reference projects.

The applicant, the applicant community and, where relevant, the granting subcontractor shall use Appendix 206 "Company-related reference projects" for this declaration. The applicant / the representative member of the applicant community has to submit this annex completed as part of the participation application. Selection criteria: The applicant must specify at least one (1) suitable company-related reference project with the application for participation.

For the selection evaluation, a maximum of four (4) enterprise-related reference projects are considered per applicant. If an applicant submits more than four (4) enterprise-related reference projects, only the first four (4) reference projects shall be considered in the order in which they are listed in Appendix 206 "Enterprise-related reference projects". Further reference projects are not considered in the selection evaluation.

If more than five (5) suitable candidates have submitted a request to participate, the client will select the candidates admitted to the tendering and negotiation phase on the basis of the following selection criteria: Selection criterion 1: Remuneration received for the contract value - EUR (net) for the advisory and support services provided between 01.01.2022 and the expiry of the participation period in the five (5) or more specified sub-areas: >= 350.000,- EUR (net) = 5 points; = 150.000,- EUR (net) (minimum requirement) = 0 points; <i> 150.000,- EUR (net) = No suitable reference project.

If the contract value (net) for the consulting and support services provided between 01.01.2022 and the expiry of the participation period in the at least five (5) specified sub-areas is between 150,000, - EUR (net) and 350,000, - EUR (net), the points are awarded by interpolation, mathematically rounded to two decimal places. Example: For a contract value (net) of the company-related reference project EUR 250,000 (net), the bidder receives 2.50 points.

Selection criterion 2: Number of sub-areas covered: The number of sub-areas covered by the enterprise-related reference project is evaluated in accordance with sub-areas 1 to 11 above. Number of sub-areas covered: 11 sub-areas = 6 points; 10 parts = 5 points; 9 parts = 4 points; 8 parts = 3 points; 7 parts = 2 points; 6 sub-areas = 1 point; 5 sub-areas (minimum requirement) = 0 points; less than 5 sub-are…

Start of continuation (Part 2)***: The applicant, the applicant community and, where relevant, the subcontractor providing the qualification shall use Appendix 206 "Company-related reference projects" for this declaration. The applicant / the representative member of the applicant community has to submit this annex completed as part of the participation application.

In the event that, after evaluating the requests to participate on the basis of the above selection method, several applicants/applicant associations with a point tie are located in one of the rear ranks and the client wishes to invite a certain number of applicants to submit an offer, the lot decides under indirect notarial supervision which of these applicants/applicant associations is invited to submit an initial offer so that the certain number is not exceeded.

If there is more than the minimum number of candidates for which there are no grounds for exclusion and who have submitted a formally correct (appropriate) request to participate in accordance with the minimum requirements, the contracting entity reserves the right, for reasons of competition, to admit more than the planned minimum number of candidates to the tender and negotiation phase.

If the number of suitable applicants is less than the minimum number of three (3), the client reserves the right to continue the award procedure by inviting the applicants who have the required suitability and meet the minimum requirements (§ 51 para 3 sentence 2 VgV). End of continuation (Part 2)***.
