What the buyer wants

The contracting authority will conclude a contract for a period of 12 calendar months with a single economic operator, following the application of the simplified procedure, for the provision of simulator maintenance services, as follows:  Software maintenance of the existing simulator – software recommissioning, software repair, ensuring conventional hardware replacement by reinstalling the software; In the event that the conventional hardware (the standard computers that are part of the simulator) breaks down, or needs to be replaced due to physical wear or obsolescence, the contractor shall undertake to ensure the reinstallation of the software on these devices (procured by the contracting authority/entity), so that the simulator as a whole retains its functionality;  Simulator-specific hardware maintenance – periodic inspection and repairs/replacement, cleaning; In the event that the specific hardware (proprietary hardware modules or equipment dedicated to the specific operation of the simulator and part of the simulator) fails, the contractor shall undertake to ensure its repair or replacement (the costs of these operations being borne by the contracting authority/entity, not forming part of the object of the contract), and the reinstallation of the equipment so that the simulator as a whole retains its functionality;  Existing simulator technical support – providing all available software modifications and rectifying deficiencies contained in the installed system. During the execution of the contract, the contractor's activity will be carried out as follows:  The contractor will perform maintenance – IT technical support, taking into consideration the latest version marketed by the manufacturer, where applicable, accompanied by manufacturer licenses;  Any subsequent version must satisfy functional requirements and take into account the existing hardware configuration;  If the subsequent version requires standard hardware or software modifications (for example, PCs with a different configuration, operating systems), the contractor will communicate this aspect to the contracting authority/entity prior to installation, in order to prevent an inoperable state and enable the purchaser to make an appropriate decision;  If required, the contractor will perform license installation and configuration activities at the purchaser's premises, as an extension of the existing system;  The contractor will provide user, operation, and administration documentation in Romanian or English, the technical description of database structures, module and procedure relationships, notation conventions used, etc.;  The contractor will provide, at the purchaser's request, technical assistance for the installation and configuration of delivered licenses at the purchaser's premises;  The contractor will provide IT technical support for software, hardware, and continuous online operation as well as on-site at the purchaser's premises upon request (no later than 2 (two) business days from the date the need is notified), throughout the entire contract period;  During the term of this contract, the contractor shall mandatorily include one service session at the beneficiary's premises, lasting at least 4 days x 1 person, including one day for installing the new software version. Travel expenses will be borne by the contractor;  The contractor will train the instructors regarding the new features/modifications introduced by the software maintenance – IT technical support;  The contractor will ensure the reissue of documents (instructor certificates) attesting that the contracting authority's/entity's personnel are qualified to conduct training corresponding to the software versions;  In the case of on-site installations (at the contracting authority's/entity's premises), the service report must mandatorily include an attached verification sheet (checklist) specifying all software and hardware modules covered by the service contract, namely, …

Servicii de mentenanta simulator: Intreținere software simulator existent – repunere in funcțiune software, reparare software, asigurarea înlocuirii hardware convențional, prin reinstalarea software. Intreținere hardware specific simulator existent – verificare periodica si reparații/înlocuire, curățare. Suport tehnic simulator existent - furnizarea tuturor modificărilor software disponibile și remedierea deficiențelor conținute de sistemul instalat. Prestarea serviciilor de mentenanta simulator se va realiza pentru o perioadă de 12 luni de la data semnării contractului de ambele părți. În conformitate cu prevederile art. 160 alin. (2) din Legea nr. 98/2016, cu modificările și completările ulterioare, Autoritatea Constractanta va transmite răspunsul consolidat formulat la solicitările de clarificări/informații suplimentare cu cel putin 10 zile înainte de termenul limită stabilit pentru depunerea ofertelor, în măsura în care sunt transmise în termenul precizat.

Economic operators submitting tenders must prove a form of registration under the law of the resident country showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional ability to carry out the activities covered by the public / sectoral contract. The requirement shall also apply to subcontractors for the part of the contract they are to undertake, which will complement the information related to their situation at the level of a separate DUAE. Method of implementation: The DUAE will be supplemented by economic operators participating in the procedure for awarding the public / sectoral contract with the information requested by the contracting authority - information on the fulfilment of the requirements for the employability. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / natural tenderers, the equivalent documents issued in the country of residence, translated into Romanian / English, are to be submitted, at the request of the contracting authority, only by the highest bidder in the ranking drawn up after the award criterion has been applied. Where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the main / secondary activities within the contract with the object of the acquisition will also be required by subcontractors for the part of the contract they will perform.

1. List of the main service providers carried out in the last 3 years - from which it appears that in the last 3 years calculated by the closing date for the submission of tenders similar services have been provided at the level of one or more contracts (service / maintenance simulators). Values will be expressed in RON / EURO. For equivalence in other currencies, account will be taken of the Inforeuro EUR / respective currency for that country in December of that year (inforeuro EUR / other currencies valid for each country can be found at: http: / / ec.europa.eu / budget / contracts _ grants / info _ contracts / inforeuro / inforeuro _ en.cfm). The demonstration of technical and / or professional capacity shall be carried out by supplementing the corresponding requirement in the DUAE form in the award documentation. In accordance with the provisions of Article 196 (2) of Law No 98 / 2016 updated on public procurement, the contracting authority will request the highest bidder after the award criterion has been applied to submit updated supporting documents demonstrating that all qualification criteria are met in accordance with the information contained in the DUAE. Usually, the documents by which economic operators can meet the requirement of similar experience are the following, not limited to: - copies of contracts or relevant parts of the contracts invoked in support of the fulfilment of the requirement, from which to reiterate the following relevant information: the name of the services provided, the beneficiary, the value, the contract period, the quality of the contractor and the percentage achieved by the contract; - certificates of delivery-receipt; - recommendations; - minutes of receipt; - certificates of record. In the DUAE completed by the tenderer, information on the existence of a third party support will be included, including the measures envisaged by it to access at any time the necessary resources to which the DUAE is attached and the firm commitment of the supporting third party / the binding commitments of the supporting third parties must result in the effective way in which the supporting third party / third parties will ensure that the undertaking is fulfilled. The supporting third party (s) will complete the DUAE with information on their level of experience, by reference to contracts executed in the past, corresponding to the support granted. By firm commitment, the third party / third party confirms that it will / will support the tenderer in fulfilling the contractual obligations, either by specifying how it will actually intervene, in order to carry out those activities for which it has supported, or by indicating the technical and professional resources it will make available to the tenderer (describing how it will achieve this). The contracting authority shall reject the proposed third party supporter if it does not meet the capacity qualification requirements or falls within the exclusion grounds and shall request the candidate / tenderer once - to replace it and to present another third party, in compliance with the principle of equal treatment. If a joint offer is submitted, each economic operator member of the association will submit the DUAE where it will include information on how to meet the technical and professional capacity requirements in proportion to the share of involvement in the execution of the future contract. Justification: Providers must have experience in providing similar services through at least one or more contracts. The requirement aims to demonstrate the similar experience of economic operators as well as the technical and organisational cumulative potential of each economic operator participating in the procedure.

Subcontractors The bidder shall provide detailed information regarding the part of the contract it intends to subcontract. If the subcontractors are known at the time of tender submission, they shall be identified according to Art. 55 of Law no. 98/2016, providing relevant information regarding the identification of the proposed subcontractors and the parts of the contract, respectively the activities for which they will be responsible during the performance of the public procurement contract. Third-party Support The technical and/or professional capacity of the bidder may be supported in accordance with Art. 182 of Law no. 98/2016. If the bidder demonstrates its similar experience by also relying on support provided by one or more third parties (pursuant to Art. 184 of Law 98/2016 on public procurement), it is required to prove the support it receives by submitting, together with the ESPD, a firm commitment from the supporting third party/parties, confirming that it/they will be jointly and severally liable with the bidder for the performance of the procurement contract, together with documents appended to the commitment, transmitted to the bidder by the supporting third party/parties, showing the actual manner in which the support will materialize. MEANS OF FULFILLMENT Subcontractors The bidder shall include information regarding the part of the contract it potentially intends to subcontract in the ESPD form from the procurement documents and shall attach the Subcontracting Agreement(s). If the bidder relies on the capacities of the subcontractor(s) to fulfill the qualification criteria, a separate ESPD form shall be submitted for each of those subcontractors, completing the data regarding the fulfillment of qualification requirements. If a subcontractor is not used to meet a qualification requirement, it will submit the ESPD solely to demonstrate that it does not fall under exclusion grounds. Supporting documents proving the fulfillment of the statements made by completing the ESPD are to be submitted only by the bidder ranked first after applying the award criterion, by the date the award procedure report is finalized, pursuant to Art. 196 para. (2) of Law no. 98/2016 on public procurement. Relevant documents to be submitted in support of statements made in the ESPD are: - Relevant documents supporting the similar experience through subcontractors declared by them in the ESPD. - Other relevant documents requested by the Contracting Authority to prove fulfillment of qualification requirements through subcontractors, as applicable. Third-party Support The bidder shall fill in the information regarding the existence of third-party support, including measures envisaged by it to access the necessary resources at any time, in the ESPD form from the procurement documents. In addition, the firm Commitment of the supporting third party shall be submitted, proving that the bidder will have access to the third party's support at all times. Along with the submission of the ESPD, the bidder shall present the commitment of the supporting third party (with documents attached to the commitment) transmitted by the supporting third party/parties, showing the actual manner in which its/their support will materialize. The supporting third party/parties shall complete the ESPD with information regarding their level of experience, with reference to contracts executed in the past, corresponding to the support provided. Supporting documents proving the fulfillment of the statements made by completing the ESPD are to be submitted only by the bidder ranked first after applying the award criterion, by the date the award procedure report is finalized, pursuant to Art. 196 para.
