The bidder (associates in the case of joint tenders, supporting third party in case of support, subcontractor for the part of services it will perform if the bidder relies on its capacity), must prove that it has provided and successfully completed in the last 3 years (calculated relative to the deadline for tender submission), similar services with a total cumulative value of min. 230,000.00 RON excluding VAT, across a minimum of one contract, maximum 3 contracts. By "similar services" is meant: consultancy services in project management/supervision and/or technical assistance for drafting/preparing and/or submitting projects and/or technical assistance for the implementation of projects funded by European and/or governmental non-reimbursable funds and/or public and/or private funds, etc., within which activities similar to those specific to project management were performed, such as, but not limited to: administrative coordination, financial management (preparation of payment and/or reimbursement and/or pre-financing claims and/or assistance for cash-flow assurance, etc.), public procurement assistance and/or monitoring the implementation of works and/or services and/or supply contracts, specialized technical assistance in the construction field, consisting, as appropriate, of: verification/analysis of technical documentation and/or technical monitoring/supervision of works execution and/or verification of compliance of executed works with the technical design, specifications, or applicable legal provisions and/or resolving/managing technical issues arising during implementation and/or participating in technical meetings and/or providing technical support to the beneficiary in relations with the designer, contractor, and other parties involved in the investment. Services are considered finalized/successfully completed in the last 3 years if they fall into one of the following categories: - partially accepted services, provided that the specific nature of the contract/activities representing similar experience allows the preparation of a deliverable that can be used by the beneficiary as an independent result; - services accepted at the end of performance; the end of performance does not imply the expiration of the warranty period, respectively of the defects notification period under FIDIC-type contracts. In the case of services submitted as similar experience, the evaluation committee is obliged, once the document confirming their acceptance within the reference period has been submitted, to take into account the entire value covered by that document, if it complies with the conditions mentioned above, without removing from the calculation the value of services pertaining to months/years outside the target timeframe. The bidder and/or, as appropriate, the associates (in the case of joint tenders) and the supporting third party (in the case of support) will confirm fulfillment of the requirement by ticking the appropriate "Yes" or "No" option in Part IV: "Selection criteria", Section α: "Global indication for all selection criteria" of the ESPD. The CA does not request, but will take into account, the technical and professional capacity of the proposed subcontractors for their share of involvement in the contract to be awarded. Therefore, subcontractors on whose capacity the bidder relies to meet qualification requirements (who also have the status of supporting third parties according to Art. 48 para. (1) of the Annex to GD 395/2016) shall complete both Part III (Exclusion grounds) and Part IV (Selection criteria) in the ESPD. Standard subcontractors on whose capacity the bidder does not rely will not complete Part IV (Selection criteria) in the ESPD. The electronically signed Subcontracting Agreement must be attached to the tender. In case of subcontracting of parts of the contract, the tenderer has the obligation to include in his offer the names of the subcontractors and their contact details, the part / parts of the contract to be fulfilled by them, the percentage to which the respective part / parts are raised, and the agreement of the subcontractors on these matters The tenderer (associations in case of joint offers) will confirm that the requirement is met by the corresponding check Yes or No in Part IV: Selection criteria of Section a: "Global indication for all selection criteria" of the DUAE. If the tenderer intends to subcontract part / parts of the contract, the DUAE shall also include information on the part of the contract to be possibly subcontractor and shall have the subcontracting agreement attached. Subcontractors on whose capacity the tenderer relies must, in turn, complete the separate DUAE, including the information referred to in Article 193 (1) (a) of Law No 98 / 2016. It is considered to be subcontracting any type of legal report between the tenderer who presents an individual or joint offer, on the one hand, and another economic operator or a professional, within the meaning of the Civil Code, on the other hand, by which the latter performs for the first time any activity (services or works) related to the performance of the performance contract that will be concluded by finalising the award procedure. If a qualification requirement is not met by subcontracting, then it shall submit the DUAE only for the purpose of demonstrating non-classification in the grounds of exclusion provided for in Articles 164, 165 and 167 in relation to the proposed subcontractors. The economic operator ranked first after the application of the award criterion shall provide proof that the qualification requirements are met by subcontractors, by submitting their supporting documents at the request of the contracting authority. Subcontracting agreement will be submitted by electronic means together with the offer and DUAE, being signed with extended electronic signature, based on a qualified certificate, issued by a certification service provider accredited under the law.
