What the buyer wants

  1. The subject of the contract is the provision of Internet access services (residence). The subject of the contract covers the following elements: - The provision of Internet access services at the location:
    • Łódź, 66A Kilińskiego Street,
    • Łódź, Solna 14. 2. The subject matter of the contract is described in the contract — Annex No 7 to the SWI, as well as in the Description of the subject matter of the contract (hereinafter referred to as the ‘OPP’), which is Annex No 1 to the SWI.
  2. Due to the specificity of the object of the contract, the Contracting Authority, acting pursuant to Article 131(2)(1) of the Act Pzp allows before submitting an offer to hold a local vision in buildings at 66A and Solna 14 Kilińskiego Street. In the course of the vision, the Contractor interested in submitting the offer will be able to inspect the place of execution of the future order. A local vision is not mandatory. A local vision can be made after prior appointment: Tel. [phone] or 42 663 316.
  3. The Contracting Authority shall require that the provision offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, both as principal elements and components, elements of the service environment or accompanying solutions, does not include:
    • ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on a national cybersecurity system, indicating their negative impact on the essential security interest of the State;
    • ICT product of which the type is specified in the decision to recognise the supplier as a high risk provider referred to in Article 67b(15) of the Act of 5 July 2018 on a national cybersecurity system;
    • ICT services, ICT processes identified in the decision to recognise the supplier as a high risk provider referred to in Article 67b(15) of the Act of 5 July 2018 on a national cybersecurity system. Failure to comply with this requirement results in rejection of the tender pursuant to point 17 of Article 226(1) or point 19 of the Pzp Act respectively.

  1. Zamawiający odstępuje od precyzowania warunku udziału w postępowaniu dotyczącego zdolności do występowania w obrocie gospodarczym.
  2. Wykonawca spełni warunek udziału w postępowaniu dotyczący uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, jeżeli wykaże, że jest uprawniony do wykonywania działalności telekomunikacyjnej będącej działalnością gospodarczą, w rozumieniu ustawy z dnia 12 lipca 2024 r. Prawo komunikacji elektronicznej (t.j. Dz. U. z 2024 poz. 1221).
  3. Zamawiający odstępuje od precyzowania warunku udziału w postępowaniu dotyczącego sytuacji ekonomicznej lub finansowej.
  4. Zamawiający odstępuje od precyzowania warunku udziału w postępowaniu zakresie zdolności zawodowej.
  5. W przypadku wykonawców wspólnie ubiegających się o udzielenie zamówienia warunek, o którym mowa: - w ust.2 musi spełnić co najmniej jeden z wykonawców wspólnie ubiegających się o udzielenie zamówienia. Natomiast każdy z wykonawców wspólnie ubiegających się o udzielenie zamówienia zobowiązany jest wykazać brak podstaw do wykluczenia go z postępowania na podstawach wskazanych w SWZ.
  6. Wykonawcy wspólnie ubiegający się o udzielenie zamówienia dołączają odpowiednio do oferty oświadczenie, z którego wynika, które usługi wykonają poszczególni wykonawcy (przykładowy wzór tego oświadczenia stanowi Załącznik nr 4 do SWZ).

Dokumenty składane wraz z ofertą: Ofertę należy sporządzić zgodnie z wzorem Formularza ofertowego stanowiącego Załącznik nr 2 do SWZ. Ponadto do oferty należy załączyć:

  1. oświadczenie, o którym mowa w art. 125 ust. 1 Pzp, o niepodleganiu wykluczeniu oraz o spełnianiu warunków udziału w postępowaniu w zakresie wskazanym przez zamawiającego w SWZ (oświadczenie to stanowi dowód potwierdzający brak podstaw wykluczenia i spełnianie warunków udziału w postępowaniu na dzień składania ofert, tymczasowo zastępujący wymagane przez zamawiającego podmiotowe środki dowodowe) – wzór oświadczenia stanowi Załącznik nr 3 do SWZ. W przypadku wspólnego ubiegania się o zamówienie przez wykonawców, powyższe oświadczenie składa każdy z wykonawców z osobna.
  2. pełnomocnictwo lub inny dokument potwierdzający umocowanie do reprezentowania wykonawcy (jeśli dotyczy) - Załącznik nr 6 do SWZ;
  3. oświadczenie wykonawców wspólnie ubiegających się o udzielenie zamówienia publicznego, z którego wynika, które usługi wykonają poszczególni wykonawcy (jeśli dotyczy) – przykładowy wzór stanowi Załącznik Nr 4 do SWZ;
  4. dowód wniesienia wadium.
