What the buyer wants
The subject of the contract is the provision of software support, hardware maintenance and other services as well as the delivery of software licenses for a firewall and web application solution of the company F5 Networks, Inc. In addition to a follow-up renewal as of 31.12.2026 ending software maintenance, hardware maintenance and cloud service agreements for the solution in use, software licenses are also to be supplied.
For further information on the subject of the contract, reference is made to the document “Description of services (APPENDIX 1 to the EVB-IT transfer agreement type A)”, which, for reasons of confidentiality of business and business secrets, is only made available to interested companies against prior submission of a declaration of confidentiality (§ 41 para 3 VgV).
For this purpose, the document "Declaration of Confidentiality (APPENDIX 6 to the EVB-IT Transfer Agreement Type A)" must be completed and signed via the message module of the electronic allocation information system "subreport" or submitted by mail to the contact point mentioned in this notice.

For the examination of the qualification and permission for the pursuit of the profession of the bidder/group of bidders, the requests in the document "Indications of suitability (APPENDIX 2 to the EVB-IT transfer agreement type A)" are used. It shall contain information on the registration in the commercial register or a comparable register by the tenderer or each member of the group of tenderers.
In order to assess the economic and financial capacity of the bidder/group of bidders and, if applicable, the suitability provider, the information in the document "Information of suitability (APPENDIX 3 to the EVB-IT transfer agreement type A)" and, if applicable, in the case of a suitability loan, in the document "Information of suitability of subcontractors (Information of suitability loan) (APPENDIX 9 to the EVB-IT transfer agreement type A)" and in the document "Declaration of commitment of subcontractors (APPENDIX 12 to the EVB-IT transfer agreement type A)" are used.
There, the bidder or each member of the bidding community as well as the suitability provider, if applicable, must provide statements on the availability of the economic and financial capacities necessary for the performance of the service and the obligation to provide suitable documents as proof on request.
In order to assess the technical and professional capacity of the bidder/group of bidders and, if applicable, the suitability provider, the information in the document "Specification of suitability (APPENDIX 3 to the EVB-IT transfer agreement type A)" and, if applicable, in the case of the suitability loan, in the document "Specification of suitability of subcontractors (Specification of suitability loan) (APPENDIX 9 to the EVB-IT transfer agreement type A)" and in the document "Declaration of commitments of subcontractors (APPENDIX 12 to the EVB-IT transfer agreement type A)" are used.
The bidder/tendering association or, as the case may be, the suitability provider has to provide there a declaration of their eligibility by the manufacturer F5 to provide the required services and a declaration that all suppliers and contact persons of the bidder/tendering association or, as the case may be, the suitability provider speak and understand the German language

The contract is awarded in accordance with § 127 Abs. 1 sentence 1 GWB on the most economical offer. The only award criterion is the total gross offer price in euros. The contract shall be awarded on the tender with the lowest total gross tender price. The (gross total) offer price is determined by the document “Offer (APPENDIX 2 to the EVB-IT transfer agreement type A)”. The price information must be entered by the bidder in the corresponding light yellow marked positions under point 6. in the “Price offer” in the document “Offer (APPENDIX 2 to the EVB-IT transfer agreement type A)”. The (total gross) offer price is the total gross price of the offer in euros, which is calculated from the total price net plus the statutory sales tax. The total price net results from the addition of all total prices into net of all price positions. The total prices in net shall be obtained by multiplying the individual prices in net by the quantity specified in the column ‘number/unit of quantity’.
