The participant must be entered in the register of persons who have notified the Commission of their intention to provide public electronic communications networks or services maintained by the CRC, be entered in the register of persons holding authorisations for the use of radio frequency spectrum – radio frequency spectrum intended for the provision of services maintained by the CRC (Communications Regulation Commission), and be entered in the register of numbering resources allocated for use to undertakings – allocated groups of geographical numbers following geographical codes and allocated access codes to digital mobile terrestrial networks, and for foreign entities – in similar registers pursuant to the legislation of the Member State in which they are established, certified by an equivalent document prepared in accordance with the national law of the participant, issued by a competent authority in the country where it is established. This circumstance is certified in Part IV, Section A of the ESPD by indicating the relevant information, and for foreign entities – by providing information on entry in similar registers pursuant to the legislation of the Member State in which they are established, certified by an equivalent document prepared in accordance with the national law of the participant, issued by a competent authority in the country where it is established. To demonstrate eligibility to pursue a professional activity in accordance with Art. 60, para. 2 of the PPA, participants shall fill in Part IV, Section A of the ESPD describing the authorisation. In the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the requirement is evidenced by submitting a copy of a document certifying the entry in the register of persons who have notified the Commission of their intention to provide public electronic communications networks or services maintained by the CRC, the entry in the register of persons holding authorisations for the use of radio frequency spectrum – radio frequency spectrum intended for the provision of services maintained by the CRC (Communications Regulation Commission), and the entry in the register of numbering resources allocated for use to undertakings – allocated groups of geographical numbers following geographical codes and allocated access codes to digital mobile terrestrial networks, and for foreign entities – a copy of a document certifying the entry in similar registers pursuant to the legislation of the Member State in which they are established, certified by an equivalent document prepared in accordance with the national law of the participant, issued by a competent authority in the country where it is established. The circumstances relating to the established requirement shall be proven by the documents under Art. 60, para. 2 of the PPA.

The participant must have performed activities with a scope identical or similar to the subject matter of the procurement within the last 3 (three) years, calculated from the date of submission of the tender. "Similar" or "identical" services to the subject matter shall mean the provision of communication connectivity and/or real-time data exchange and/or the provision of IP Virtual Private Networks (IP VPN) and/or the provision of MAN data transmission services and/or the provision of dark fiber and/or their equivalents. "Completed" shall be understood as a service whose execution has been concluded prior to the date of submission of the tender, regardless of the date of its award. The circumstance is certified in Part IV, Section C of the ESPD, by providing information on the activities with a scope and volume identical or similar to those of the procurement, indicating the values, dates, and recipients. In the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the requirement is proven by a List of services that are identical or similar to the subject matter of the public procurement, indicating the values, dates, and recipients, together with proof of the performed delivery. "Proof of the performed service" means: a certificate issued by the recipient of the service or by a competent authority, or indication of a public register where information about the service is published.

The participant must have an implemented quality management system according to the EN ISO 9001:2015 standard or equivalent, with a certificate valid as of the date of submission of the tender with a scope including the provision of electronic communications services or data transfer and transmission or the provision of a transmission medium. This circumstance is certified in Part IV: "Selection criteria", Section D: Quality assurance standards of the ESPD by specifying the standard according to which they apply an implemented and certified quality management system and entering information regarding: (1) the name of the Standard applied, (2) the unique identification number of the Certificate/equivalent document held by the participant, (3) the subject scope of the Certificate/equivalent document held by the Economic Operator, (4) the date of issuance of the Certificate/equivalent document, (5) its period of validity, (6) the certifying body/organization issuing the document, and (7) the public register containing information on the availability of this Certificate (if applicable). If the relevant documents are available in electronic format, the following shall be indicated: web address, issuing authority or body, exact reference to the document. In the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the requirement is certified by copies of quality management certificates. Note: The certificate under item 3.2 must be issued by independent entities accredited under the relevant series of European standards by the Executive Agency "Bulgarian Accreditation Service" or by another national accreditation body that is a party to the Multilateral Agreement of the European co-operation for Accreditation for the relevant field, or meet the recognition requirements under Art. 5a, para. 2 of the Law on National Accreditation of Conformity Assessment Bodies. The contracting authority shall also accept other evidence of equivalent quality assurance measures where a candidate or participant has had no access to such certificates or had no possibility of obtaining them within the relevant time limits for reasons beyond its control.
