1. The participant must hold a valid Authorization for the use of an individually assigned scarce resource – radio frequency spectrum for the provision of public electronic communications via terrestrial mobile networks with national coverage, issued by the Communications Regulation Commission. Participants shall certify their compliance with this requirement by filling in information on the held Authorization(s) in Part IV, Section A of the ESPD. To prove compliance with this requirement in the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the Public Procurement Act (PPA), participants shall submit copies of valid Authorization(s) for the use of an individually assigned scarce resource – radio frequency spectrum for the provision of public electronic communications via terrestrial networks with national coverage, issued by the Communications Regulation Commission (CRC). 2. The Contracting Authority sets a requirement that the Participant must hold a valid Authorization for the use of an individually assigned scarce resource – numbers for the provision of public electronic communications, issued by the CRC. Participants shall certify their compliance with this requirement by filling in information on the held Authorization(s) in Part IV, Section A of the ESPD. To prove compliance with this requirement in the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, participants shall submit copies of valid Authorization(s) for the use of an individually assigned scarce resource – numbers for the provision of public electronic communications. 3. The Contracting Authority sets a requirement that the Participant must be entered in the public register of undertakings that have notified the CRC of their intentions to provide public electronic communications – Public telephone services - Mobile telephone service pursuant to Art. 33, para. 1, item 1 of the Electronic Communications Act (ECA). The participant shall declare compliance with the requirement set by the Contracting Authority by filling in Part IV, Section A, "Selection criteria" of the ESPD, indicating information on the existence of registration pursuant to Art. 33, para. 1, item 1 of the Electronic Communications Act (ECA). To prove compliance with this requirement in the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, participants shall submit copies of a certificate issued by the CRC for registration in the Public Register of undertakings that have notified the commission of their intentions to provide public electronic communications (Art. 33, para. 1, item 1 of the ECA) or a reference/excerpt of registration in the Public Register of undertakings that have notified the commission of their intentions to provide public electronic communications. Note: In the event that the participant is a foreign person/entity, it may submit a valid equivalent document, declaration, or certificate issued by a competent authority of a Member State of the European Union, or of another state party to the Agreement on the European Economic Area, proving the participant's entry in the relevant register of that state. At the stage prior to the conclusion of a public procurement contract, in accordance with Art. 112, para. 1, item 4 of the PPA, the foreign person/entity must complete registration and submit a document issued by the CRC certifying its rights to provide the services subject to the procurement on the territory of the Republic of Bulgaria.

Participants must have performed activities with a subject-matter identical or similar to those of the contract over the last three years, calculated from the date of submission of the tender. Minimum requirements: Over the last three years, calculated from the date of submission of the tender, the participant must have performed at least 1 (one) activity with a subject-matter identical or similar to the subject-matter of the contract. 'Activity with a subject-matter identical or similar to that of the contract' shall be understood as 'provision of electronic communications services'. When submitting a tender, the information regarding the requirement is declared in Part IV 'Selection Criteria', Section C 'Technical and professional ability' in the ESPD. In the cases of Art. 67, para. 5 and Art. 112, para. 1, item 2 of the Public Procurement Act (PPA), compliance with the requirement is proven by a list of supplies or services that are identical or similar to the subject-matter of the public procurement, specifying the values, dates, and recipients, along with documents proving the delivered supply or service.

Participants must apply quality management standards: an ISO 9001:2015 quality management system or equivalent with the scope of 'provision of electronic communications services'. This circumstance is certified in Part IV: 'Selection Criteria', Section D: Quality assurance standards of the ESPD by indicating the standard according to which they apply an implemented and certified quality management system and entering information regarding: (1) the name of the Standard applied, (2) the unique identification number of the Certificate/equivalent document held by the participant, (3) the subject-matter scope of the Certificate/equivalent document held by the Economic Operator, (4) the date of issue of the Certificate/equivalent document, (5) its validity period, (6) the certifying body/organization that issued the document, and (7) the public register containing information on the existence of this Certificate (if applicable). If the relevant documents are available in electronic format, the following is indicated: web address, authority or body issuing the document, exact reference to the document. In the cases of Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the requirement is certified with copies of quality management certificates. Note: The certificate under item 3.2 must be issued by independent bodies accredited under the relevant series of European standards by the Executive Agency 'Bulgarian Accreditation Service' or by another national accreditation body that is a party to the Multilateral Agreement for Mutual Recognition of the European co-operation for Accreditation for the relevant field, or meet the recognition requirements under Art. 5a, para. 2 of the Law on National Accreditation of Conformity Assessment Bodies. The Contracting Authority shall also accept other evidence of equivalent quality assurance measures where a candidate or participant had no access to such certificates or had no possibility of obtaining them within the relevant deadlines for reasons beyond their control.
