Special authorisation in the Republic of Bulgaria is required for the performance of services covered by the contract. Minimum requirement: 1.1. The participant must be entered in a register of persons who have notified the Communications Regulation Commission (CRC) of their intentions to provide public electronic communications networks, or in an equivalent register, under the legislation in the country where the participant is established; 1.2. The participant must have a valid permission to use an individually defined limited resource When submitting the offer, on the basis of Art. 67, para. 1 of the Public Procurement Act, the participant shall declare compliance with the specified fitness requirements by filling in the information in Part IV. In the event that documents are freely accessible and prominent from a public register, the participant in the same field may also indicate details of the relevant internet address/link for direct access. Subject to the conditions of Art. 67, para. 5 of the Public Procurement Act and Art. 112, para 1, item 2 of the Public Procurement Act, the requirements shall be demonstrated by the presentation of a certified copy of: - certificate of entry in the register under Art. 33, para 1, item 1 of the LEC issued by the CRC; - permission for use of individually designated limited resource. In the event that the participant is a foreign person, he may provide a valid equivalent document or declaration or certificate issued by a competent authority of a Member State of the European Union or to another State Party to the Agreement on the European Economic Area demonstrating the entry of the participant in a relevant register of that State. Note: In the event that the participant is a foreign person, he may present an equivalent document or declaration or certificate issued by a competent authority of a Member State of the European Union or another country country side of the Agreement on the European Economic Area proving the entry of the participant in a relevant register of that State and/or the right of the participant to perform the service in case the contracting entity makes use of the opportunity of vizied in Article 67 (5). Prior to the conclusion of a contract for public procurement and in accordance with Art. 112, para 1, item 1 of the Public Procurement Act, the foreign person should submit a permission to use an individually defined limited resource under the Law on Electronic Communications issued by the CRC and a certificate of entry in the register under Art. 33, para 1, item 1 of the LEC issued by the CRC.

2.1. Participants in this public procurement must have achieved a minimum total turnover of €825,630.00 (eight hundred twenty-five thousand six hundred and thirty euros), calculated on the basis of the annual turnovers over the last 3 (three) completed financial years, depending on the date on which the participant was established or commenced its activity, pursuant to Art. 61, para. 1, item 1 and para. 7 of the PPA. Minimum requirement: Minimum total turnover of €825,630.00 (eight hundred twenty-five thousand six hundred and thirty euros), calculated on the basis of the annual turnovers over the last 3 (three) completed financial years, depending on the date on which the participant was established or commenced its activity. For a participant that is a foreign person, the turnover will be calculated according to the official exchange rate of the BNB for the relevant currency in euros as of the date of bid submission. Upon submitting a bid, participants must declare their compliance with the specified selection criterion by submitting an electronic European Single Procurement Document (eESPD) and filling in the relevant information in Part IV "Selection criteria", letter B "Economic and financial standing", field "General yearly turnover". In the cases of Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the specified requirement is proven with the following documents: Annual financial statements or constituent parts thereof, where their publication is required under the legislation of the country in which the candidate or participant is established; Statement of total turnover. Where, for a valid reason, a candidate or participant is unable to submit the documents requested by the contracting authority, it may prove its economic and financial standing by means of any other document that the contracting authority deems appropriate. The participant must have implemented and apply a quality management system compliant with BDS EN ISO 9001:2015 standard or equivalent, with a scope of certification corresponding to the subject matter of the contract. The certificate for an implemented quality management system must be valid and issued by independent entities accredited under the relevant series of European standards by the Executive Agency "Bulgarian Accreditation Service" or by another national accreditation body that is a party to the Multilateral Agreement on Mutual Recognition of the European co-operation for Accreditation, for the relevant field, or meet the recognition requirements pursuant to Art. 5a, para. 2 of the Law on National Accreditation of Conformity Assessment Bodies. The Contracting Authority accepts equivalent certificates issued by bodies established in other Member States. The Contracting Authority also accepts other evidence of equivalent quality assurance measures where a participant had no access to such certificates or had no possibility of obtaining them within the relevant time limits for reasons beyond its control. In this case, the participant must be able to prove that the proposed measures are equivalent to those required. Proof: Upon submitting the bid, pursuant to Art. 67, para. 1 of the PPA, the participant declares compliance with the specified selection criterion by submitting an ESPD completed in Part IV, Section D: "Quality assurance standards and environmental management standards". The participant must provide information on the relevant quality management systems, including number and date of issue, validity period, scope of the certificate, as well as the certifying body that issued it, and/or a web address /link/ where the specified information can be found. Under the conditions of Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, the requirement is proven by submitting a copy of a certificate of conformity of the participant's quality management system with standard BDS EN ISO 9001:2015 or equivalent, valid as of the date of bid submission, with a scope corresponding to the subject matter of the procurement. IMPORTANT For the purposes of this public procurement, "scope corresponding to the subject matter of the public procurement" shall be understood as Internet access or data transmission and transfer or provision of transmission media. IMPORTANT: The Contracting Authority will not require documents to which it has official access or access via a public register, or which can be provided through direct and free access to the national databases of the Member States. In this case, participants should indicate the web address, the authority or service issuing the document, an exact reference to the document, etc. The Contracting Authority may not accept submitted evidence of technical and professional abilities where it originates from a person who has an interest that may lead to a benefit within the meaning of Art. 76 of the Counter-Corruption Act among persons holding public office.
