Selection of an operator for the provision of telephone services to the Ministry of Environment and Water and its structures' with two lots

The participant must hold a valid Authorisation(s)/Permit(s) for the use of an individually assigned scarce resource – radio frequency spectrum for the provision of public electronic communications via a terrestrial network allowing the provision of electronic communications services, issued by the Communications Regulation Commission (CRC). Participants shall certify their compliance with this requirement by filling in information regarding the held Authorisation(s)/Permit(s) in Part IV, "Selection Criteria", Section A "Suitability" of the ESPD. To prove compliance with this requirement in the cases under Art. 67, para. 5 and Art. 112, para. 1, item 2 of the PPA, participants shall submit copies of valid Authorisation(s)/Permit(s) for the use of an individually assigned scarce resource – radio frequency spectrum for the provision of electronic communications via a terrestrial network allowing the provision of electronic communications services, issued by the CRC.

The participant must have performed at least 1 (one) activity with a subject matter identical or similar to that of this procurement for the last 3 (three) years, calculated from the date of submission of the tender. An "activity similar to the subject matter of the procurement" shall be understood as: provision of mobile and/or radiotelephone services. "Performed activities" shall be understood as activities whose execution was completed within the three-year period established by the Contracting Authority, calculated from the date of submission of the tender for participation in this procedure. The Contracting Authority will accept as sufficient activities that are identical or similar to the subject matter of the procurement, regardless of the volume in which they were implemented. To certify their compliance with this requirement, participants shall complete Part IV, "Selection Criteria", Section C "Technical and professional ability" of the ESPD, indicating the completed activities that are identical or similar to the subject matter of the lot, specifying the values, dates, and recipients. If a participant uses subcontractor(s), evidence of the commitments undertaken by the subcontractor(s) must be submitted in the tender. Pursuant to Art. 67, para. 5 of the PPA, the Contracting Authority may require at any time after the opening of tenders the submission of all or part of the documents proving the information specified in the ESPD, pursuant to Art. 64, para. 1, item 2 of the PPA, where this is necessary for the lawful award of the procurement, namely: a list of services that are identical or similar to the subject matter of the lot, specifying values, dates, and recipients, together with documents proving the service provided. The participant designated as the contractor shall submit, prior to concluding the contract, the documents proving its compliance with the criteria for technical and professional ability established by the Contracting Authority, pursuant to Art. 112, para. 1, item 2, in conjunction with Art. 64, para. 1, item 2 of the PPA, by submitting a list of services that are identical or similar to the subject matter of the lot with indication of values, dates, and recipients, along with documents certifying the service performed. The Contracting Authority may reject submitted evidence of technical and professional ability when it originates from a person who has an interest that could lead to a benefit within the meaning of Art. 76 of the Act on Counteracting Corruption among Persons Holding Public Offices (ZPKSLZPD). The documents certifying compliance with the set selection criteria shall also be submitted for subcontractors and third parties, if any and applicable, according to the type and share of the contract they will perform, provided that there are no grounds for their exclusion from the procedure.
