Renewal of support service for the Darktrace system for identifying anomalies related to cyber threats

The Contractor shall demonstrate that he has carried out or performs duly within the last 3 years from the date on which the time limit for the submission of tenders expires and, if the period of business is shorter, within that period, at least 1 (one) contract (the contract) which included or covers within a period of at least 12 months the provision of technical support to the manufacturer for the NDR (Network Detection and Response) class system, and the contract value (the contract) in the above range was at least PLN 750 000,00 gross*. * Where the value of the contract is expressed in a currency other than in Polish zlotys, The Contracting Authority shall convert the value of the completed contract in another currency into Polish gold – on the basis of the average rate of gold in relation to the foreign currency specified in the Table of National Courses of the Bank of Poland, which shall apply at the date of publication of the notice of the contract in the Official Journal of the European Union. 2.

In order to confirm the fulfilment of the condition of participation, the Contracting Authority shall require the submission of a list of supplies or services performed and, in the case of services which are repeated or continuously performed, within the last 3 years from the date on which the time limit for the submission of tenders expires and, if the period of business is shorter, within that period, including the value, subject matter, dates of performance and entities for which the supplies or services have been carried out or are carried out, and the addition of evidence indicating whether those supplies or services have been performed or are duly performed, with the evidence referred to, with references or other documents drawn up by the entity for which the supplies or services have been carried out, and in the case of services which are repeated or continuous, and where the contractor is unable to obtain such documents, the contractor's declaration;

in the case of benefits which are repeated or continued references or other supporting documents are duly performed, they should be issued within the last 3 months. 3.

Article 117(3) of the Act shall apply to Contractors jointly applying for the award of contracts, taking into account Article 117(4) of the Act. 4. An economic operator may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between them, to confirm that the conditions for participation in the procedure are met.

In that case, the Contractor shall submit the obligation referred to in Article 118(3) and (4) of the Act with the offer. 5.

Pursuant to Article 112(3) of the Act The Contracting Authority shall not apply the capacity levels specified in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors (Journal of Laws of 2025 item 1235 as amended), since for the subject of the contract referred to in this SWZ, the capacity levels have not been specified.

The Contractor is obliged to demonstrate that he or she will have at least 2 persons at his or her disposal, who will be directed by the Contractor to carry out the contract, and each of these persons shall speak and write the Polish language and have appropriate professional qualifications and experience, i.e. 1.1. has experience in at least 1 (one) undertaking involving the provision of service services Contractors for the software offered in the offer;1.2. has professional qualifications in service offered by the Contractor in the software offer, confirmed by the manufacturer's certificate or other equivalent document** issued by the software manufacturer or training centre authorized by the software manufacturer. ** Under the concept of equivalent document, the Contracting Authority understands another professional document/certificate issued by the software manufacturer or training centre authorized by the software manufacturer, confirming the qualifications in service offered by the Contractor in the software offer.

In order to confirm the fulfilment of the condition of participation, the Contracting Authority requires that a list of persons addressed by the Contractor for the performance of a public contract, in particular those responsible for the provision of services, quality control or management of construction works, together with information on their professional qualifications, powers, experience and education necessary for the performance of a public contract, as well as on the scope of their activities and on the basis of their disposal.
3. Article 117(3) of the Act shall apply to Contractors jointly applying for the award of contracts, taking into account Article 117(4) of the Act.
4. An economic operator may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between them, to confirm that the conditions for participation in the procedure are met. In that case, the Contractor shall submit the undertaking referred to in Article 118(3) and (4) of the Act together with the offer.
5. Pursuant to Article 112(3) of the Act The Contracting Authority shall not apply the capacity levels specified in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors (Journal of Laws of 2025 item 1235 as amended), since for the subject of the contract referred to in this SWZ, the capacity levels have not been specified.
